Dragonfly Energy Corp. (“Dragonfly Energy,” “we,” “us,” or “our”) is a North American battery manufacturing and energy storage solutions company headquartered in Reno, Nevada. This Privacy Policy applies to information we collect through dragonflyenergy.com and its related content, features, and services (the “Site”), as well as through email, phone, and other direct communications with us. 

Dragonfly Energy operates the following brands and websites, each of which is governed by its own separate privacy policy: 

This Privacy Policy does not apply to those brand websites, their associated mobile applications, or to the investor relations portal at investors.dragonflyenergy.com, which is operated by a third-party platform subject to its own privacy policy. 

Please read this Privacy Policy carefully. By using or accessing the Site, you acknowledge that you have read and understand the collection, use, and disclosure of your information as described herein. If you do not agree with our practices, please do not use the Site. 

1. Personal Information We Collect 

When we use the term “personal information,” we mean information that identifies or can reasonably be linked to you or your organization. This does not include anonymized or de-identified information. Depending on how you interact with the Site, we may collect the following categories of personal information: 

  • Contact information: including your name, email address, phone number, job title, and company or organization name, collected when you reach out to us directly via email or phone. 
  • Communications: including the content of emails or other messages you send to us, and records of those communications. 
  • Device and usage information: including your IP address, browser type, operating system, pages visited, time spent on pages, referring URLs, and other information about how you interact with the Site, collected automatically through analytics and tracking technologies. 
  • Business visitor information: including firmographic data such as company name, industry, and general location associated with your IP address or network, collected through third-party business visitor identification tools even if you have not contacted us directly. See Section 5 for details. 

We do not collect financial information, process payments, or handle e-commerce transactions through this Site. 

 

2. How We Collect Information 

We collect personal information through the following means: 

  • Directly from you: when you contact us by email or phone, inquire about our products or services, request information, or otherwise communicate with us voluntarily. 
  • Automatically through the Site: including through cookies and similar tracking technologies as you navigate the Site. This may include usage details, IP addresses, and behavioral data collected through our analytics and advertising tools. 
  • From third-party tools and partners: including business visitor identification platforms that may associate your device or network with your employer or organization, even without direct interaction from you. 

3. How We Use Your Information 

We may use the information we collect for the following purposes: 

  • To present and improve the Site: including understanding how visitors use the Site, measuring audience size and engagement, and improving content and functionality. 
  • To respond to your inquiries: including answering questions about our products, services, technology, or partnership opportunities, and maintaining our business relationship with you. 
  • For marketing and advertising: including sending promotional communications by email or other means, and showing you relevant advertisements on this Site and on other platforms based on your activity and interests. 
  • For business development: including identifying prospective business partners, OEM customers, and other commercial opportunities using data collected through business visitor identification tools. 
  • For security and fraud prevention: including detecting, investigating, or taking action against potentially fraudulent, illegal, unsafe, or malicious activity affecting the Site or our systems. 
  • For legal and compliance reasons: including complying with applicable law, responding to valid legal process including requests from law enforcement or government agencies, investigating or participating in civil discovery or litigation, and enforcing or investigating potential violations of our terms or policies.

Please note that inbound calls to our team may be recorded for quality assurance and training purposes. By calling us, you consent to this recording. Dragonfly Energy does not share recorded call information with third parties. 

 

4. How We Disclose Your Information 

We may disclose your personal information to third parties in the following circumstances: 

  • Service providers: including vendors and third parties who perform services on our behalf, such as IT management, data analytics, cloud storage, and communications. These parties are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. 
  • Business and marketing partners: to provide marketing services and show you targeted advertising through platforms such as Google Ads and Meta (Facebook) Ads. Our partners will use your information in accordance with their own privacy notices. 
  • Corporate affiliates: including other entities within the Dragonfly Energy Corp. corporate group, including our brands Battle Born® and Wakespeed®. 
  • Business transactions: in connection with a merger, acquisition, reorganization, dissolution, bankruptcy, or similar transaction, in which personal information held by Dragonfly Energy may be among the assets transferred. 
  • Legal obligations: to comply with applicable law, respond to court orders, subpoenas, search warrants, or similar legal process, and to protect the rights, property, or safety of Dragonfly Energy, our customers, or others. 
  • With your consent: for any other purpose disclosed by us at the time you provide your information, or otherwise with your consent. 

We may also disclose aggregated, de-identified information about our website visitors without restriction, as this information cannot reasonably be used to identify any individual.

5. Cookies and Tracking Technologies 

We and our third-party partners use cookies, pixels, tags, and similar tracking technologies on this Site to collect information about your device, browsing behavior, and interactions. We use Complianz as our cookie consent management platform (CMP). 

We use the following categories of tracking technologies: 

Analytics 

  • Google Analytics 4 (GA4): Used to analyze website traffic, user behavior, session patterns, and site performance. Data collected includes pages visited, time on site, device and browser type, and general geographic location. GA4 may also be used to build advertising audiences for use in Google Ads campaigns. 

Advertising 

We use advertising pixels to track conversions, measure campaign performance, and serve relevant advertisements to visitors on other platforms. The use of these tools may constitute a “sale” or “sharing” of personal information under applicable privacy laws. You have the right to opt out of these uses (see Section 7). 

  • Google Ads: Used for conversion tracking and remarketing. Enables us to measure the effectiveness of advertising campaigns and serve targeted ads to past Site visitors across Google’s ad network and properties. 
  • Meta (Facebook) Ads: Used for conversion tracking and audience targeting for advertising on Facebook and Instagram. 

Business Visitor Identification 

  • ZoomInfo WebSights: We use ZoomInfo WebSights to identify the company or organization associated with a visitor’s IP address. This tool may collect firmographic data, such as company name, industry, and general location, linked to your device’s network. This data may be collected even if you have not contacted us directly or filled out any form. It is used to identify prospective B2B customers and partners for our sales and business development activities. ZoomInfo’s use of data is governed by its own privacy policy. 

Managing Cookie Preferences 

When you first visit the Site, you will be presented with a cookie consent banner powered by Complianz that allows you to accept or decline non-essential cookies. You may also configure your browser to refuse all or some cookies, or to alert you when cookies are being sent. Please note that disabling certain cookies may affect the functionality of parts of the Site. Additionally, if you visit our Site with the Global Privacy Control (GPC) opt-out preference signal enabled, we will treat this as a request to opt out of the sale or sharing of your personal information for the device and browser you are using.

6. Third-Party Websites and Links 

The Site contains links to third-party websites, platforms, and resources, including our brand websites, investor relations portal, career listings, social media profiles, and partner sites. If you follow links to sites not operated or controlled by us, you should review their privacy and security policies independently. We are not responsible for the privacy practices, content, or accuracy of any third-party site. Our inclusion of such links does not imply any endorsement of those sites or their operators. 

 

7. Your Rights and Choices 

Depending on where you live, you may have some or all of the following rights regarding your personal information. These rights are not absolute, may apply only in certain circumstances, and we may decline your request as permitted by law. 

  • Right to Access / Know: You may have a right to request access to personal information we hold about you. 
  • Right to Delete: You may have a right to request that we delete personal information we maintain about you. 
  • Right to Correct: You may have a right to request that we correct inaccurate personal information we maintain about you. 
  • Right of Portability: You may have a right to receive a copy of personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions. 
  • Right to Opt Out of Sale or Sharing for Targeted Advertising: Depending on where you reside, you may have the right to opt out of the “sale” or “sharing” of your personal information, or to opt out of the processing of your personal information for targeted advertising purposes (as those terms are defined in applicable law). You may exercise this right by contacting us directly using the information in Section 14, or by using your browser’s cookie controls. We do not sell personal information in the traditional sense, but the use of certain advertising and analytics technologies described in Section 5 may constitute “sales,” “sharing,” or targeted advertising under applicable privacy law. 
  • Managing Email Preferences: If you have received marketing communications from us, you may opt out at any time by following the unsubscribe instructions in those communications or by contacting us directly. 

We will not discriminate against you for exercising any of these rights.  

To submit a request, please contact us using the information in Section 14.  We may need to verify your identity before processing your request. You may designate an authorized agent to make requests on your behalf.  In order to verify your authorized agent, you must provide the authorized agent with signed, written permission to make such requests on your behalf or power of attorney. If permitted under applicable law, we may also follow up with you to verify your identity before processing the authorized agent’s request. 

If we deny your request to exercise any of the rights above, you may appeal that denial by contacting us using the information in Section 14. 

Nevada residents: We do not currently sell personal information in a way that triggers the Nevada Revised Statutes Chapter 603A opt-out requirements, but you may submit a request to opt out of any potential future sales under Nevada law to [email protected]. 

8. Notice to California Residents 

If you are a California resident, the California Consumer Privacy Act (“CCPA”) requires us to disclose certain information about how we process personal information and sensitive personal information (as those terms are defined in the CCPA).

Sources of Personal Information.  We collect this information directly from you, automatically through the Site, or from third-party tools and partners. 

Your Privacy Rights.  For information about your privacy rights, please see Section 7 above.  You also may have the right to receive information about the financial incentives that we offer to you (if any).  

Sensitive Personal Information.  The CCPA allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes.  We do not collect sensitive personal information about you.  

“Sale” and “Sharing” of Personal Information.  We do not sell personal information in the traditional sense, but we may disclose certain identifiers (like IP address and email address), internet or other electronic network activity information (like information regarding an individual’s browsing interactions on the Site), and inferences to certain analytics, advertising, and marketing providers in ways that may be considered “sales” under the CCPA.  We may also “share” this information (as defined by the CCPA) with advertising platforms and advertising networks to provide more relevant and tailored advertising to you regarding our products and services.  See Section 7 for information about how to opt out of these disclosures. 

We do not knowingly “sell” or “share” the personal information of children under 16.

9. Children’s Privacy 

This Site is not intended for use by children under 16 years of age. We do not knowingly collect personal information from children under 16. If you believe we may have inadvertently collected information from a child under 16, please contact us using the information in Section 13 and we will promptly delete it.

 

10. Security and Retention of Your Information 

We take reasonable measures to help protect your personal information from unauthorized access, use, or disclosure. However, no security measures are perfect or impenetrable, and we cannot guarantee absolute security. We recommend that you do not use unsecured channels to communicate sensitive or confidential information to us. 

How long we retain your personal information depends on factors such as whether we need it to maintain a business relationship with you, to comply with legal obligations, to resolve disputes, or to enforce our contracts and policies. 

 

11. International Visitors 

This Site is operated from the United States. If you access it from outside the United States, please be aware that your personal information may be transferred to, stored, and processed in the United States, where our operations are based. Data protection laws in the United States may differ from those in your country of residence. By using this Site or providing us with your information, you acknowledge and consent to this transfer and processing.

We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will post any revised Privacy Policy on this page and update the “Last Updated” date at the top. If we make material changes to how we treat your personal information, we will provide notice on our Site homepage. Your continued use of the Site following any changes constitutes your acceptance of the revised policy. You are responsible for periodically reviewing this page for updates.
